1. Program Overview

The GamerTech Affiliate Program ("Program") allows approved partners ("Affiliates") to earn commission by referring customers to GamerTech ("Company", "we", "us") via unique referral links. By applying to and participating in the Program, you agree to these Terms & Conditions in full.

2. Eligibility & Approval

To be eligible for the Program:

• You must be a legal resident of Canada and at least 18 years of age.
• You must have an active platform, website, or community relevant to gaming, technology, or PC hardware.
• Applications are reviewed at GamerTech's sole discretion. Approval is not guaranteed.
• GamerTech reserves the right to reject or revoke any application or active membership without stated cause.

3. Program Benefits & Attribution

3.1 Commission & Customer Benefits

Approved Affiliates receive a commission for qualifying sales attributed to their unique referral link. The specific commission rates, any customer discount associated with the referral link, and the list of qualifying product categories are communicated privately to each Affiliate upon approval. These terms may be updated by GamerTech with reasonable written notice to active Affiliates.

3.2 Eligible Products

Commissions apply only to qualifying product categories as defined in the approval communication sent to each Affiliate. Peripheral-only orders, accessory-only orders, and repair services are generally not eligible for commission unless explicitly stated otherwise.

3.3 Attribution

Attribution is tracked via a first-click referral cookie with a 30-day duration. A sale is attributed to the Affiliate whose referral link was clicked first by the customer, provided the purchase is completed within 30 days of that click. If a customer clears cookies or uses a different device, attribution cannot be guaranteed.

4. Commission Approval & Payment

4.1 Approval Timeline

Commissions enter "pending" status when an order is placed. They are moved to "approved" status after the order is confirmed delivered and any applicable return or refund window has fully closed.

4.2 Refunds & Cancellations

If an attributed order is refunded, cancelled, or charged back, the associated commission is voided. If that commission has already been paid out, the amount will be deducted from future payouts.

4.3 Payout Method & Frequency

Approved commissions are paid monthly via Interac e-Transfer to a Canadian bank account provided by the Affiliate. Payouts are issued within the first 10 business days of each calendar month for the prior month's approved commissions.

4.4 Minimum Payout Threshold

A minimum payout threshold may apply. If an Affiliate's approved balance is below the threshold at month end, it rolls over to the following month. The current threshold, if any, is communicated to each Affiliate upon approval.

5. Prohibited Conduct

The following actions are strictly prohibited and may result in immediate termination and forfeiture of pending commissions:

• Cookie stuffing: Artificially injecting referral cookies into users' browsers without a genuine click.
• False advertising: Making inaccurate claims about GamerTech products, pricing, or services.
• Incentivized clicks: Offering cash, prizes, or other incentives specifically for clicking your referral link.
• Spam: Distributing referral links via unsolicited email, SMS, or comment spam.
• Brand impersonation: Registering domain names, social handles, or ad campaigns that imply you are GamerTech.
• Paid search brand bidding: Running paid advertisements that bid on "GamerTech" or closely related brand keywords without prior written approval.

6. Brand Usage

Affiliates may use GamerTech's name, logo, and approved marketing materials solely for the purpose of promoting the affiliate partnership. All other use of GamerTech trademarks or intellectual property requires prior written approval. GamerTech may update or revoke brand usage rights at any time.

7. Disclosure Requirement

Affiliates must clearly disclose their affiliate relationship with GamerTech in all promotional content, in compliance with the Competition Bureau of Canada guidelines. A clear disclosure such as "This video/post contains an affiliate link. I earn a commission if you purchase through my link." is required.

8. Program Modifications & Termination

GamerTech reserves the right to modify, suspend, or terminate the Affiliate Program at any time. Material changes will be communicated with at least 30 days' notice. Either party may terminate the partnership at any time. Upon termination, earned commissions for confirmed delivered orders will still be paid on the regular payout schedule; pending commissions for undelivered orders will be forfeited.

9. Limitation of Liability

GamerTech is not liable for indirect, incidental, or consequential damages arising from your participation in the Program. Total liability is limited to the commission amounts owed to you as of the date of any claim.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
